Republicans tearing into President Biden for a missing deadline.Release information about the Wuhan Lab's possible links to the origins of the COVID pandemic.Congress voted unanimously back in March to give the United States 90 days to make that intel public.But that deadline came and went.Yep, Biden administration didn't cough that up.The White House directed Fox to DNI Averl Haynes office.Her office said they've been carefully declassifying the report.House Intelligence Committee Chair Mike Turner had this to say this certainly is a deadline that was passed, that was put in law.She's going to have to have some explaining to do in addition to produce these documents.When these documents are made public and they're read, they're going to be in sharp contrast to the unclassified version that was put out by the Biden administration.I think that'll also give people pause because they'll believe that the administration was being disingenuous when they released their unclassified statement.Fox has now confirmed a prominent United States funded scientist who worked on coronavirus projects is one of three Chinese researchers who became very ill with an unspecified illness during the initial COVID outbreak.Well, those things were talked about, but we were stickered on Twitter if we ask questions about them.Kat Kamek, Republican Congresswoman of Florida, member of the Energy and Commerce Committee and the Select Subcommittee on the Weaponization of the Federal Government.Great to see you today.What should we be focusing on as we learn this new information?Well, Harris, it seems like every day is a game of whack a mole with this administration.If it's not one thing, it's another.We're seeing that this deadline has been missed in conjunction with this bombshell report that has been verified that Patient Zero actually worked in the taxpayer funded Wuhan Lab.So that in itself right there means that there is so much more for us to uncover.But of course, what we've seen in the past from the Biden administration is them continually missing statutorily declared deadlines, like the budget, for example.So you have to ask yourself, is this incompetence or is this malice?At this point, neither is acceptable.What we need to do is continue to uncover all of these documents.But more than anything, the American people deserve to see the unclassified document.They need to know the truth about the origins of COVID and what the administration and Congress has known all along.It's that transparency and accountability that Americans, regardless of party, have been demanding.And I think that they're hesitant to do so because they recognize that this report that they are, quote, unquote, attempting to declassify and has been taking so long that it flies in the face of the political narrative that they have been pushing out there.They're going to have some explaining to do.And as we know, Mr.Colleen, he's on perpetual duty with the White House.They are constantly walking back statements.This is going to be one more example of that.Yeah, it also complicates where we are with China right now.I mean, how can you hold their feet to the fire when you hold no leverage?Which is what some of my guests, like Representative Mike McCall said recently with our Secretary of State sitting down with President Xi of China, they got us.All right, let's move on.After Hunter Biden's plea deal with the Department of justice, house Oversight Chair James Comer promised to forge ahead with its investigation ongoing into the Biden's.

Is there a world in which employers are just going to have to accept a new normal that in office business model has changed?I think we're seeing that hybrid work is now our permanent reality.I mean, more than half of workers whose jobs allow them to be remote are now hybrid.For a while, we thought maybe this was a COVID thing, but now air travel is back up to its pre pandemic levels and dining reservations are up to their pre pandemic levels.It's just the office that's been kind of stuck in that mushy hybrid zone.So I think companies are coming to accept that the office is not going to look like it did in 2019 and employees who want a hybrid model will just look somewhere else because there are so many companies still offering it.Exactly.Emma Goldberg, thanks so much for being here.Thanks for having me on.

Now, some companies are offering incentives to those who come into the office more regularly.For more on this, let's bring in Emma Goldberg.She covers the future of work for The New York Times.Emma, I am into this topic.Just to start, tell us what are some of the incentives companies are using to try to get people back in the office?Yeah, I mean, it really runs the gamut.I think companies thought for a while that they wouldn't have to try any incentives, that they could just say, come back and workers would comply.But it's played out a little bit more like a game of chicken where executives have said, can you come back to the office?And workers have kind of looked at them and said, like, are you going to make us so the incentives range.I mean, we've seen happy hours.We've seen free lunches.Some tech companies have done concerts like a Lizzo performance.I went to a home buying company in lower Manhattan that was doing a game night and happy hour in the office.And then salesforce now is saying to every employee who comes in, they'll make a $10 charitable contribution to a cause of their choice.So that's kind of a nice spin on the incentive.I was going to ask, is anyone offering money that's a little bit like offering money?There are companies that I've heard about that are offering even bonuses for people who are coming in.So they are going there where they're basically saying, like, we'll hand you a check if you do the commute.All this for something that was standard three years ago.I mean, are these incentives working?I think that that still remains to be seen a little bit because we've seen a real swelling of worker pushback.

In your piece, an executive at DocuSign said the subject of return to office can be quite polarizing.Why?I think when we talk about return to office, we're really talking about how we live our lives.So for the past three years, people have seen that they can actually kind of undo some of the assumptions that have made their working lives challenging.Whether it's working mothers who realize that they can do school pickup in the afternoon and then log on to finish their work after dinner, or employees of color who have found that they don't have to face microaggressions when they don't go into the office.So I think it's necessarily emotional because we're not just talking about commutes and finding parking.We're talking about people's families and their lives.Is there a world in which employers are just going to have to accept a new normal that in office business model has changed?

Return to Office Polarization

Believe it or not, it's been over three years since the pandemic began, and many companies are still struggling to get employees to come back to the office.A survey conducted last month by WFH Research found only 59% of workers are in the office full time, 29% are hybrid, and 12% are fully remote.Now, some companies are offering incentives to those who come into the office more regularly.

I think that that still remains to be seen a little bit because we've seen a real swelling of worker pushback.I mean, the other week at Amazon, there was a walkout of corporate workers, and one of the issues that they were expressing their frustration over was the return to office.So I think you're seeing workers express their frustration with these policies in very vocal ways.And for the past couple of years, they have been really strengthened by the tightness of the labor market.There's been like two job openings for every unemployed person.So I think workers have felt like they have the momentum and the power behind them to say that they won't come in.Yeah, it's a tricky topic.In your piece, an executive at DocuSign said the subject of return to office can be quite polarizing.

Worker Pushback and Power

What is the point, I guess, or how should a President engage with those kinds of leaders either in the naming of them or in the dealing with them?Look, it's complicated.The President of the United States has a lot of equities.And when I was president, I would deal with figures in some cases who were allies who, if you pressed me in private, do they run their governments and their political parties in ways that I would say are ideally democratic?I'd have to say no, of course not.But you had to do business with them because they're important for national security reasons.There are a range of economic interests.I dealt with China to get the Paris Accords done.I dealt with Modi to get the Paris Accords done because I think climate change is something that transcends any particular momentary issues.It's a problem that humanity has got to deal with over the next several decades in a serious way.I do think that it is appropriate for the President of the United States where he or she can, to uphold those principles and to challenge whether behind closed doors or in public trends that are troubling.And so I'm less concerned about labels than I'm concerned about specific practices.I think it is important for the President of the United States to say that if you have Uighurs in China who are being placed in mass camps and reeducated, quote unquote, that's a problem.That's a challenge to all of us and we have to pay attention to it.I think it is true that if the President meets with Prime Minister Modi, then the protection of the Muslim minority in a majority Hindu India that's something worth mentioning.And by the way, if I had a conversation with Prime Minister Modi, who I know well, part of my argument would be that if you do not protect the rights of ethnic minorities in India, then there is a strong possibility India at some point starts pulling apart.And we've seen what happens when you start getting those kinds of large internal conflicts.So that would be contrary to the interests not just of most Muslim India but also Hindu India.So I think it's important to be able to talk about these things honestly.You're never going to have things are never going to be as clean as you'd like because the world is complicated.

Now, this story begins 25 years ago with the war of independence in Kosovo following the breakup of the former Yugoslavia.A group of rebels known as the Kosovo Liberation Army fought for the freedom of their province from the Republic of Serbia.And it was a very bloody conflict.It ended only when NATO intervened by bombing targets in Serbia.In the years that followed, as you may know, right, the international legal community focused on the war crimes from that era, and they mainly focused on the former Yugoslavian President Milosevic in Kosovo and throughout the Balkans.But in 2008, accusations of war crimes on the Kosovan side emerged.In a tell all book written by a Swiss prosecutor.She alleged the Kosovo Liberation Army, or the KLA, that was the rebels that were fighting had also committed tortured that they had even harvested organs from Serbian prisoners.After the Council of Europe published evidence of some of those same claims, in 2011, a special court was set up at The Hague specifically focused on those crimes.And seven years later, in 2018, jack Smith arrived to take over what was called the Kosovo Specialist Prosecutor's Office.Now, by that time, when he arrived in 2018, the court's efforts had largely stalled.It was kind of a more abundant investigation.I mean, at this point, it had been nearly two decades since the actual war and the war crimes had been committed.And crucially, the former leaders of that rebel army, the KLA, were now in charge of the newly independent country.One of them, Hashim Atachi, rose to become the Prime Minister and then the President.As one of Jack Smith's predecessors explained, the task at hand was like prosecuting Kosovo's equivalent of Benjamin Franklin and Alexander Hamilton, quote, if you indict these people, you're saying the founding fathers of Kosovo have committed atrocities, and I'm ready to prove it in an independent court with independent judges and rules that apply to everyone.Another former head of the specialist prosecutor's office, Clint Williamson, explained that Smith focused on getting witnesses that had contributed to the process earlier to come on board again.And then Smith and his office focused on the chain of command.Williams says, quote, this is not unlike organized crime prosecutions.A mafia boss very rarely pulls the trigger himself.You have to develop the linkages between the trigger puller and the big boss who's giving the orders.Well, the work paid off in June of 2020, in the midst of a global pandemic, when Smith's office announced that it was seeking an indictment against the then sitting president of the new nation, Kosobo Hashim Thachi, and included ten counts on various war crime charges, including nearly 100 murders and the torture of hundreds of victims.

So Dark Patterns are what agencies like the FTC and researchers call all the different ways websites that sell you a product or a recurring subscription try to make it a little harder for you to get rid of that or to cancel.That could be an option that's sort of hidden in the corner, not able to be seen.It could be the way that you have to click through many different pages to eventually get what you want any way that a website basically doesn't make it straightforward to get what you want.Here in the FTC's case, they're saying that when somebody signs up for prime, it is difficult to cancel if for some reason somebody wants to cancel.The FTC is also alleging that Amazon is signing people up for prime without really explaining to customers that's what it's doing.In certain cases, when somebody wants to buy something on Amazon and they click on the prime deal, I can sort of see that sometimes the way these websites and Amazon is one of them, when you're buying, for example, an item, it might automatically check, mark, subscribe, so you get it like every three months.And then it certainly happened to me where I didn't realize I was getting this regularly until it came again two months later.Then I was like, I don't want this.And you're right.Like, the process of unsubscribing is kind of cumbersome.It takes time.How is Amazon responding to these allegations?Amazon is saying that the allegations that they're doing anything that is purposely hurting customers or illegal, according to US.

A word that Durham used repeatedly was that the findings that he had were sobering.And then he used a word that's what's needed is accountability.And I think it's the accountability part that's not happening.I don't see it happening, and I don't know if even anybody on either side would be satisfied with accountability.The left has decided that they think the DOJ and FBI are biased against them, the right things that the FBI and the DOJ are biased against the right.So I actually really don't know how you deal with that.Durham, to me, was a very credible public servant.He had to sit there and take it from somebody like Adam Schiff, who that very day is being censured by the House for perpetrating the whole thing.He talked about how he spent four years away from his family dealing with this thing, and he has to imagine because of you, and now you are in a position of power in the House in order to question me.Adam Schiff loved this today, and the House members were helping him to basically raise a lot of small dollar money.

Adam Schiff loved this today, and the House members were helping him to basically raise a lot of small dollar money.He's in a primary in a fight in California.He wants to get that Senate seat that Diane Feinstein is likely going to vacate or the one that they hoped to be able to win.All of those guys have to be looking at this going, wow, Adam Schiff is the one who's going to come out on top of this thing.On the Democratic side, I mean, that is just Washington DC.For you.Tulsi before these hearings, how does this work?Did the staff get together?They come up with these talking points.Do the members get together and stay on message?Is there a strategy here?That's what happens every time.And that's why you see the lines of attack.They actually do go through that preparation and they figure out, okay, who's going to take this line of attack?Who's going to take this other line of attack?So that they're not all saying the exact same thing, but they're all going back to the same major point, which is a reminder to all of us of the power of the Hillary Clinton machine that extends across the national security state, the propaganda media, big tech.It's a reminder of the Democrats playbook I've had some experience with of refusing to address substance and evidence and instead immediately going towards smear and destruction and outright saying, we will destroy your reputation.There's no qualms about exactly what their objective is.And I agree with him.Yes, accountability is what's necessary here.I have no faith that it will occur for the reasons that Dana talked about and especially under the Biden administration.I think what really needs to happen again, I agree with Durham.

Adam Schiff's Political Strategy

Will historians actually write this fairly because this is somebody they truly despised, right?Today's historians despise trump.They're just going to get older and write more books.So no matter what happens here, the truth is never going to get out.And I think that's it's kind of a depressing story in the way that Republicans really aren't good at this because politics isn't personal for them, so they can't do the theater the way the Democrats do.And so what you watch today was kind of an, ohum, it wasn't that exciting when you aren't a liberal, scandals, they just don't work for you.You know what I mean?The press controls the outcome.The Dems do political theater better than anybody else, and you even have Adam Schiff gets to grill the actual investigator.How is that possible?It's an amazing thing.I'm jaded.I guess I'm jaded.How do you have accountability when so many people are in on it.That's the problem.And I do think it would be great to see the FBI disbanded.But I can't believe I would say that, because I used to watch FBI Ephraim Zimblist Jr.Remember?That's how I learned Roman letters.Was it roman letters?Remember, each part segment would go part one.All right, thanks, you guys.Thank you.Thank you.No, but I love that show.And now we're like, everything that the Democrats touch undermines it.But one was television, and now you know the facts.Yeah.Unfortunately, I prefer TV.Me too.The left used to want to disband the FBI.Now the right does, and maybe they can agree on that.I don't know.I don't know what to do.No one on cable news ever says that you're brave.

All right, Dan, I'm going to start with you.RFK is visiting San Francisco recently, went down to see the border.I think we talked about it last week.How is this style of doing things different compared to what Biden is doing, which is high fiving everybody at fundraisers.So I do feel that with the Hunter Biden announcements today that the Biden campaign is getting serious.I don't necessarily think that going to campaign events where you're shaking hands and doing basically no rallies or anything like that is a surprise for him.An incumbent president, he's got to go out there and raise a lot of money.They're a little bit behind in fundraising, so they're trying to catch up.That all makes sense to me.However, if you want to make a difference and you want to make a splash, you do something like what RFK Jr.And Vivek Ramaswami have done.Even DeSantis went to the border.All of this makes a ton of sense if you're trying to, one make get attention, especially in a crowded GOP primary.But on the Republican on the Democratic side of things, this issue of homelessness is so big and if you are the President of the United States, your job is to make big decisions and solve big problems.You should want to do that.Talking about climate change in California might get you some money from the tech CEOs.It is not going to get you the answers that you need to help solve a problem that's biggest in California but growing all across the country as I don't even know if what RFK Jr.Is suggesting would actually work.Does Section Eight housing vouchers to some of these people out here?Is that going to get them off the street?I actually don't know if that's the right answer.I think a lot of them have mental health problems where that wouldn't even be something that they could handle.But from a campaign perspective, I think it makes a lot of sense for them to get some earned media attention.Plus, a lot of people are getting their news and their information about the campaign on their phone, so those types of videos make a lot of sense.Yeah.Greg, I saw you shake your head with a housing voucher concept that I think it's vivek thinks is important to resolving the homelessness issue.

Greg, I saw you shake your head with a housing voucher concept that I think it's vivek thinks is important to resolving the homelessness issue.Yeah, it was actually.It was RFK who brought it up, and I admire him.I think he's the most persuasive candidate out there.But I agree with you.I don't think these are not families on the street.I mean, if anybody who spends their time I go up Six Avenue every day, you're not going to hand these people a voucher and they're going to return to this happy Leave It to Beaver stability.You're talking about people who daily reject other people's help, right?The drug addicts, the mentally ill, the criminally deranged that are there.You hand them a voucher and if they can't sell that for drugs, they'll hit you with it.So I think that what would help RFK would probably be to hook up with Schellenberger, michael Schellenberger, who's been on top of the homeless situation in California for some time and has a lot of great ideas there.I think RFK is a very complicated, intensely persuasive person.But there was some stuff on Rogan that I felt was troubling.And I think that a really good way to debate him would be to find out what the difference between the claims that he finds most important and the ones that are somehow, like, recreational.Like, he believes in this sort of thing, but he starts talking about WiFi radiation.That feels like a recreational belief, something to ponder, like UFOs.And I would really like to as somebody that really thinks he's really onto something, I think he needs to delineate between some of the things that he believes truly are happening and some things that he's exploring in his brain on Rogan.Jessica americans like transparency, and I think RFK is the embodiment of transparency because whether it's his going on Rogan or just doing these little videos from his phone, whereas Joe Biden is the guy who's got to read from the teleprompter blow through a fundraiser.

So let's ask about the creaky or not institutions in the United States.The spectacle of a former president being federally indicted.How is the rest of the world, the democratic world, maybe even the non democratic world, meant to interpret that indictment?And indeed, the fact that a federal indictee is running is able to run for the highest office in the land, maybe even the world.It's less than ideal.But the fact that we have a former president who is having to answer to charges brought by prosecutors does uphold the basic notion that nobody's above the law and the allegations will now be sorted out through a court process.I think I'm more concerned when it comes to the United States with the fact that not just one particular individual is being accused of undermining existing laws, but that more broadly we've seen whether it's through the gerrymandering of districts, whether it's trying to silence critics through changes in legislative process, whether it's attempts to intimidate the press a strand of antidemocratic sentiment that we've seen in the United States.It's something that is right now most prominent in the Republican Party, but I don't think it's something that is unique to one party.I think there is less tolerance for ideas that don't suit us and sort of the habits of a free and open exchange of ideas and the idea that we all agree to the rules of the game.And even if the outcomes aren't always the ones we like, we still abide by those rules.I think that's weakened since I left office, and we're going to need to strengthen them again.So I do need to ask you then, a follow up on that, because what happens if Donald Trump wins again?

So I do need to ask you then, a follow up on that, because what happens if Donald Trump wins again?It's said that the institutional guardrails of American democracy were strong enough to survive a one term presidency.Are they strong enough to survive if that kind of person personality wins again?I won't speculate on the outcome of a future election.Obviously.I'm a Democrat.I've got a deep, I mean, the institution interest in the outcome.But I'll make a general statement, which is, having been President of the United States, you need a president who takes the oath of office seriously.You need a president who believes not just in the letter, but in the spirit of democracy.And the essential spirit of democracy is that as President of the United States, you are just one representative of the people in a series of co equal branches.There are checks and balances to the system.You are subject to those checks and balances.You cannot ignore them.You cannot make your own rules.You cannot view the Justice Department as your personal law firm.You cannot ignore norms and guardrails that have been put in place to assure that your self interest isn't what drives these institutions, but is rather the interests of the American people.And so if you have anybody who's occupying that office who disregards that higher, that higher purpose, then you're going to have problems.The good news is that through the mechanism of voting, the American people are going to have the opportunity to reaffirm their belief in American democracy.The other thing, Christiana, I do think that what happens in the United States matters around the world.

The other thing, Christiana, I do think that what happens in the United States matters around the world.And, and the thing sometimes I'm asked what surprised you about being president, and I said, you know, I knew I was going to be busy, and I knew that obviously, the United States is an extraordinarily powerful country.The idea of America, the idea of the possibility of a multiracial, multiethnic, multireligious, large, big, complicated country still being able to function as a democracy, that is an important idea for the world.And when it looks like America's democracy is teetering or breaking down, then I think it emboldens those who do not believe in democracy around the world, and it worries and weakens democratic forces in other places.So President Biden man, who you know extremely well, has made the defense of democracy the sort of centerpiece of his administration, it just so happens that right now there's also not just threats to democracy by dictatorships and autocrats, but also illiberal democracy as well.He has called the President of China a dictator, and they're sticking with it.He is also hosting, as we speak, the Prime Minister of India, Modi, who is considered autocratic or at least a liberal Democrat.What is the point, I guess, or how should a President engage with those kinds of leaders either in the naming of them or in the dealing with them?

All right.President Xi Ji Ping, a dictator, as you know, called by the president a dictator yesterday.Not the best diplomacy.The President also said when it comes to the balloon, that the President she was embarrassed by it, and that no idea it was there and was angry that it was shot down.And according to the intelligence community, that was the intelligence.That not should have been said publicly.Can you imagine if Trump did that?I can't.It's such a double standard.And listen, President Biden has no idea how to conduct with diplomacy.He says crazy stuff that hurts relationships, that keeps us from securing our country.And now that they're building a training base at Cuba and have the intention to do that, that jeopardizes our national security to an even greater extent.It's why I've continuously talked about the fact that we have resources in the middle of this country is where we should be putting our security operations.We have been doubling and tripling our cybersecurity training university so that we can have those protections that being in the middle of this country provides.We don't have Russian subs and ships conducting surveillance off of the coasts of South Dakota.We're protected by our own people.We don't have bases on Cuba that are a threat to us.So we've been training the NSA, employers, employees here in South Dakota.We've been putting in security operations at our Air Force base, knowing that the safest part for a lot of our security information is in the middle of our country, not out on the coasts anymore.But this can't stand 100 miles off our border, a failed government, Communist government, and they'll do training right off our border.Their comeback is, well, you have Taiwan, you militarize Taiwan.Why don't I?Militarize cuba.What's your response?Well, it should be unacceptable.Absolutely.It shouldn't surprise us.And I think that our reaction right away should be to protect our country, move our necessary security operations to the middle of the country so that we have them protected by our people, by our land mass.This isn't a new thought.We've talked about doing it for years.We need strong action, and then we need to go out there and make sure we're shutting down that camp and not allowing it that close to the United States of America that can't stand, and that's a no brainer.How do you talk to China and that not come up?Meanwhile, Governor Nome, domestically, you have a mission, and that's to fill some of the thousands of jobs that you have open.

But my question for you is, since your whole strategy now when it comes to 2024, is to make sure that Donald Trump is not the Republican nominee, isn't that messaging playing right into his hands?I think that a lot of the media messaging is not the media playing what they're saying.Well, the message is he can't win, right.It's not a personal thing between me and former President Trump or Chris Christie.He can't close the deal in November of 24, he's going to lose to Joe Biden and more importantly, he costs us seats, right?So we saw in 22, he caught him and his message and his candidates cost us Senate seats.They cost us governor seats, they cost us school board seats all the way down because you have Republicans that have to almost explain why they might be supportive of the president.We got to move forward.We just got to move on.I think the Republican Party has an awesome opportunity to say we're about going forward.We're not about relitigating the past and getting rid of this drama.We're talking about a plea deal.Anytime we talk about a politician or a politician's family and the word deal comes up, all of America goes, really?They get a deal, but we don't get a deal.So whether it's Hunter Biden, whether it's an indictment with Trump, whether it's the allegations of bribery against the current president, we're all just tired of the drama.And anytime you add deal into the Republicans should just stop talking about it.Is that what you're saying about Trump?No.About the hunter biden plea deal.Well, no.Look, I think America is frustrated with it.I don't think you necessarily stop talking about it other than to say, what are you about if you want to be president, you're not going to get elected president because you're bashing on the Hunter Biden deal.So to say you have to be president because you're going to bring fiscal responsibility, you're going to secure the border, you're going to do all these things that Republicans, I think, have a great record in doing, but you're not going to get it by, again, just talking about politics and relitigating.You don't win by being against the other person.You win by being for something and inspirational and getting folks to galvanize.And none of these candidates seem to be galvanizing anyone on their team.They don't seem to understand how to do that.Well, on that note, I know one of your big arguments, as I said, is that you don't believe Donald Trump, if he's the nominee, can win in November, in large part because he can't necessarily reach independence.

Okay, so I want to ask you about that as well, because I want to put back up the general poll number from yesterday with the sort of top line from all of the candidates who are in the race.You see that Trump went down a bit, but he's still way ahead of the person who's closest behind him.DeSantis 26, pence nine, and so on and so forth.Your whole thing is getting behind one of the opponents to Donald Trump.I think everyone does at least define one when, oh, there's plenty of time.We haven't gotten the debates yet.Right?So you're going to have probably 6789 debates.You don't think by then it's going to be too late?No, not necessarily.Before Iowa.Look, most voters actually don't make up their mind till three weeks really, who they're going to vote for till about three weeks before the election.New Hampshire and Iowa, retail states like that, they still have to hit the ground.They still have to have their moments.I remind folks it was a time ago, but no one knew who Herman Cain was.He came up with nine nine nine surge to the top of the polls.Everyone thought Rick Perry could win.He had a tough moment on the debate stage.It fell apart.Marco Rubio was surging.Chris Christie took him apart.So there's a lot of game to play out here.You have a super Pac.

You have a super Pac.Live free or die.Are you going to use that at all to run ads against Donald Trump in New Hampshire?No.Look, my message is going nationally is trying to get more independence onto the team.Understand that we're not just defined by the presidential candidate.If it were to be Trump on the top of the ticket, more young people, more young voters, suburban moms, these are the constituencies we have lost in droves, and which is why we don't hold the Senate anymore, which is why we don't have more governors anymore.So we're trying to get folks a little more inspirational, inspired, and more aspirational until the opportunities for bringing those real Republican values not Donald Trump's baggage, but Republican values of fiscal discipline and local control, limited government, individual responsibility, you come first, not the government.Those are great things that independents want to galvanize, but we need candidates to carry it.So you are the sitting governor of New Hampshire, which for Republicans is still the first in the nation primary state, but Democrats have said, no, they're going to go to south.

Let's talk about some of those issues.I think you started off right.Where when I think about when we were in the majority, we passed tax reform.I had the good fortune of writing the domestic side of our tax reform TCJA, the Tax Cuts and Job Act that we passed in 2017.We cut the taxes of a single mother like the one that raised me by 70%.That's what Republicans did for dual income households.We cut taxes for dual income households by 60%.We said we'd give back to the American people $4,000 on average.We gave back $4,400.But what we also did was we had high employment, low inflation because the government did not print and spend money.We gave it back to the American people because we believed in we the people.Give you your money back, let you live your lives, and things get better.We got to do that again.Is there a way to restrain government spending?Because every time absolutely.So controlling government spending is what I said earlier.Please, please fire Joe biden.That's the first thing you have to do.And here's the second thing you have to understand, and we all understand it because we're living at 49% of Americans or so median income in this country is 1750 or $35,000 a year.Because of Joe Biden's inflation, the average monthly expenses have increased by $500 almost.That's not a problem.That's a crisis for people on fixed incomes and single moms that raise me.And the reason why that's happened is because they printed and then spent $4 trillion, the way we say it in the south.Just turn the spigot off.Don't spend what you don't have.Let me ask.Don't print what you don't need and don't buy stuff you can't afford.That's called South Carolina.That's just how we do it.So you live within your means.I always like, Connie Mac had the penny plan.We probably need a nickel plan at this point.So we're going to cut government spending, lower government taxes, and then we've got issues.I think energy independence would go a long way incredible.

The expert Genealogist here spent months tracing my lineage, and this was the day of the long awaited reveal.Make sure you got a box of Kleenex by you and sit there and enjoy.That's the museum's top genealogist, Dr.Shelley Murphy, on the laptop.She's joining us from the University of Virginia.This is a tree.Just a snapshot of your tree.And I'm following your maternal line.Wow, that's a lot.Just seeing the tree.You see that box?Well, that represents David Venny, my great grandfather's great grandfather.He lived in coastal Richmond County, Virginia, on a farm with his wife Judy and their 18 children.And in 1871, he filed this claim to be reimbursed for livestock and supplies requisition by Union troops during the Civil War.Another thing that is significant is that he owned the land that he's on, and it was 23 acres.Where did a man in the 1870s, so soon after the end of slavery, get the money to buy 23 acres?Absolutely.And the thing of it is, I would even question he said he was freeborn.Well, for some answers, we have to go back more than 300 years to my great great great great great grandmother, Mary.She arrived on a ship in Northumberland County, Virginia, in 1712.Before America.Was America her granddaughter?My eight times great grandmother Bess, was with her.That's according to this centuries old deposition that Dr.Murphy's team uncovered.Why a deposition?We'll learn that a little later.And Bess at the time was about 13 years old.Witnesses apparently said they looked like they were Indians.Researchers believe that Mary and Bess were actually Mattabanai, like these people of that region of Virginia called the Northern Neck.We're not sure where they came from, but Thomas Smith of Richmond County did enslave one of Bess's children, and that was Sarah.And it's Sarah, my seven times great grandmother, who changes the trajectory of her children and all her descendants who followed.There was a law back in 17 five that declared that all children that are enslaved or free, their condition would be based on whatever their mother was.

During the break, LZ, that it's so difficult to trace the lineage of African Americans because for centuries, enslaved people were inventory.They didn't keep accurate birth and death and marriage for as much as marriage was recognized or acknowledged.Those records.Absolutely.And because of the constant selling and reselling and loaning and bringing back, it wasn't possible to keep up.You know what's so brilliant about the women in your family that the law that you were talking about was designed because of all the sexual assaults through all these pregnancies, and it was like, what do we do with these mixed race children?They created that law so that those children would be born into slavery.The fact that the women in your family took that law and flipped it and flipped it brilliant.Absolutely brilliant.Incredible research and incredible story.And I just found myself wondering, with all the restrictions on curriculum that are being imposed in about half the country, it will become extremely difficult, if not impossible, for many young people to kind of learn this story or its equivalent.I mean, it's quite a moment in the country.Our thanks again to the international African American museum.They have the resources on their website for you to start this journey of your own.As they continue to grow, they will do this on a one on one basis, but this is a stunning display of african american history there at the port in charleston.Again, thanks to them.

Well, we heard from the archivists that every administration since Reagan has delivered to them documents that included classified and unclassified documents mixed.And 80 members of Congress have sent documents to libraries where the libraries had to subsequently get in touch with them and say, we found classified documents, including Senator Muskie, who had 98 classified documents.This is a systemic problem now with respect to this litigation.It's going to go forward and I'm certainly not going to defend the behavior that is listed in that complaint, but they're going to have to prove it and it's a legal process that's going to have to go forward.Let's talk about a few other topics because on Tuesday your committee is going to hear closed door testimony from Trump appointed Special Counsel John Durham.

Systemic Problem of Classified Documents

Let's talk about a few other topics because on Tuesday your committee is going to hear closed door testimony from Trump appointed Special Counsel John Durham.His report concluded that the FBI should not have launched the full Trump Russia investigation as it did.It would have been okay to do a preliminary one, but not the full bohr one.What do you want to know from former Special Counsel Durham?So this is very troubling because this is going to be troubling for you, especially as you read that the Durham report, after the years of which there were these accusations of Trump Russia collusion and that these allegations were absolutely false.What's concerning here is not that a campaign would make those accusations.The Clinton campaign did opposition research or the Clinton campaign made these accusations.It's when it comes to you as the government speaking, when the government opens an investigation over uncorroborated information that they take directly from a political campaign and they make it a government investigation.I mean, this was not just the initial investigation itself.Then it resulted in the special prosecutor.Every investigation that has occurred, including now the Durham report is conclusively states that this was a result of people who had political bias, who undertook an investigation based upon total Clinton campaign funded research that was uncorroborated and turned out to be even untrue.And that's where you have to be concerned when your government's lying to you, when your government is telling you that something has happened that has not happened, that's when our committee has to be involved.And that's when we have to look at what happened here.How do we make certain this doesn't happen again?How do we make certain that we don't have people with a political bias entering into political campaigns and using the authority of the government to have major media and the government take actions that are not based on truth?You've said you want to explore possible changes to the FBI.

John Durham's Testimony and FBI Investigation

You've said you want to explore possible changes to the FBI.Director Rey has said he's already made a ton of changes and Special Counsel Durham did not recommend, quote, any wholesale changes in the guidelines and policies that the department and the FBI now have in place.Unquote.So what do you want to consider changing?Sure.So what you're talking about is the portion of the Durham report that relates to the FISA, the Foreign Surveillance Act and the FISA Court itself and the whole application process where the FBI lied to the FISA court to get yeah.And that FBI agent, I believe, was disciplined.What we have found is that there are problems in the entire process with the FISA courts in which people are not held accountable.And it's across the board that there is in Bipartisan bicameral that people believe that this needs to be changed.Now Durham didn't say, I don't recommend any changes, meaning there are no changes that need to be made.He said in the document he said no wholesale changes.Right.In the document he delivered.He didn't think it was appropriate to include those.He did, however, and I've spoken to him directly, agree that he would give us his insight as to what changes he thinks need to be made and that's the work that our community is doing, our committee is doing.We're pulling him in to our committee to say, okay, now that we've seen that there were abuses, that this was wrong, and that there are problems with FISA itself, what are the recommendations that you think we should pursue?Here are some of the things we're looking at.What do you think of these?So it's a closed door testimony, closed door hearing.I hope that you'll issue whatever you can publicly so we can report on it.Thank you so much for being here today.I appreciate it.Mr.Chairman.

Well, the work paid off in June of 2020, in the midst of a global pandemic, when Smith's office announced that it was seeking an indictment against the then sitting president of the new nation, Kosobo Hashim Thachi, and included ten counts on various war crime charges, including nearly 100 murders and the torture of hundreds of victims.In fact, the announcement came while Thachi himself was in midair, flying to the United States for a meeting with none other than, yes, then President Donald Trump.The two men had met before in New York and in Paris, but these were to be formal talks at the White House meant to boost Trump's diplomatic bonafides.Now, a source told the Dilly Beast, it now appears that prosecutors, with their announcement, were trying to stop Thachi from using that meeting with Trump to pressure the United States to drop the case against him.After learning of the indictment, Thoughtchi did cancel the visit and return home to Kosovo.A little over four months later, after a judge confirmed the charges against him, thoughtchi resigned from the presidency.He flew to The Hague, where he was taken into custody.The man who had been the sitting president of this new nation, a hero, a founding father.And Jack Smith continued methodically plugging away at his work, trying several of former allies in the KLA.Your Honors, this is a case about the conditions required for the fair administration of justice and attempts by the accused to block the path of justice for so many.This is a case about what is required to make rule of law a reality.Think of that line.Think of that line.This is a case about what is required to make the rule of law a reality.Now, even without Jack Smith, who of course has got a new job, hashim thought she's trial continues.The Hague.It's ongoing.He remains in detention, of course, just like Donald Trump.The former president of Kosovo remains innocent until proven guilty.He is due process.We do not know the outcome of his trial or what it will be.Although the Kosovo Specialist Prosecutor's office has since convicted three other people.And with Jack Smith back here in the US.

I think what really needs to happen again, I agree with Durham.You can't just nibble around the edges with the FBI.They're so endemically corrupt and politicized at this point.There needs to be a top to bottom overhaul or just disband the FBI and come up with a new agency and start fresh and charge people with the actual responsibility the FBI should be fulfilling.It's hard to get accountability because Durham never even interviewed Comey, never subpoenaed McCabe, never subpoenaed Glenn Simpson.I wonder why.I don't know.This is the problem.Will historians actually write this fairly because this is somebody they truly despised, right?

It is worth pointing out that many existing services that were around before the internet are really hard to cancel.Cable is really hard to cancel.There are other subscription services out there.Hulu, Netflix, certain fashion websites you might be subscribed to, the video website Vimeo that are really hard to cancel.Some of them are harder than Amazon to cancel.I've seen side by side comparisons.So Amazon is certainly not the only online commerce website that makes it, quote, unquote, difficult to cancel.It may not even be the most difficult, but Amazon has a huge scope, a huge size.It's very popular.Many customers rely on it, use it every day.A lot of people love it.But I think that Amazon is constantly in the crosshairs of the Federal Trade Commission because of its size, its power, compared to its competitors.

We are back now with our panel.Elliot, to you.How much damage do you think that Trump has done to his defense with this latest interview?This is why defense attorneys tell their clients, do not talk, do not give interviews, do not speak publicly.He did not confess to the crimes that he's accused of, but he did provide evidence that, number one, he knew he possessed them, and number two, that he knew there was an ongoing investigation.Both of those pieces of information are relevant to obstruction of justice and this question of possession of defense related information.So he didn't do himself any favors at all.And, Maggie, we heard Chris Christie earlier saying that his legal team must be looking for the first window to jump out of.This must illustrate perfectly why he is such a difficult client.He's going against the advice of his legal counsel.That's one of many reasons I don't actually know.To be clear that his legal counsel told him not to go on TV.We know that Trump also likes lawyers who let him do what he wants, and this is clearly something that he wanted to do.But to Elliot's point, it isn't just that he acknowledged having them.I mean, I was thinking about a key part of the obstruction was the obstruction of the grand jury subpoena.This indictment really focuses squarely on that.And part of that was that a lawyer for Trump wrote an attestation saying that there had been a diligent search of the property and that they didn't turn anything else up.So Trump is basically saying, yep, I still wanted more time to go through stuff.If that's true, then why did you let your lawyers who were representing him at the time go into this?So to your point, this is often why he has trouble attracting people.There's two reasons lawyers.One is because he is unmanageable as a client.The other is people don't get paid sometimes.And so neither one of these seems like it's helping.And in terms of the timeline, judge Eileen Cannon has now said that the trial date is set for just under two months from now on August 14.

And in terms of the timeline, judge Eileen Cannon has now said that the trial date is set for just under two months from now on August 14.Elliot, how realistic is that?It is not this case is not going to trial in August.The judge sort of had to do that to respect the defendant's speedy trial rules or speedy trial rights.But it's not uncommon for judges to set that date and then push it forward once the motions and complicated things come in.This is going to be a very complicated case in terms of dealing with how you get classified information in front of jury that's going to take months to resolve.The parties all know that.The judge knew that, and they actually could have worked out some sort of arrangement to set a trial date further ahead in the future.I'm not quite sure why they didn't, but it's not going to trial in August.I think the judge is very keen on not being seen as the person who is holding this up.I think that's the big issue, and one of the biggest questions is to what extent Republican voters will respond to this indictment.

I think that's the big issue, and one of the biggest questions is to what extent Republican voters will respond to this indictment.Abby, we have a new CNN poll showing that support for Trump has dipped since this indictment.Of course, he is still the front runner by quite a large margin, by double digits.So what does that say about the president's, the former president's staying power?I mean, I do think that he has quite a lot of staying power.Republican voters have really taken a lot from Trump.This is clearly I mean, he's been impeached twice.That's already part of the portfolio here.I think voters know that this is one of many criminal cases that he could face.He was already facing one in New York that's somewhat baked into the cake.But what you're seeing in those numbers is probably not just the effect of the indictment.It's also the entrance of other candidates into the race as well, some tugging at his numbers in some ways.The one person that I think so many Republicans are hanging their hat on, ron DeSantis, did not move really at all in the numbers, which suggests to me that there's not a huge exodus from Trump.It's still going to be a game of getting a plurality of voters in the Republican primary, and that is still much easier for Trump to do where he is sitting right now than any other person in the field.Maggie, we just have a few moments left.Your impressions?There's no question about it.Look, I mean, this is definitely shows this is one poll and this is a reliable poll, but it's one poll, it shows a bit of a dip.You know, everything that we have seen so far over time is that these indictments actually generally help Trump.He may face another indictment, at least one over the coming weeks.This race seems frozen, as best as I can tell, even with these variations.Yeah, there's lots more that still could come.We have to leave it there.Thank you all.Really appreciate your time and your perspective this evening.

Let's turn to the Trump indictment, because as the chairman of the House Select Committee on Intelligence, these national security documents are very important and you know a great deal about the subject.You've seen, actually, some of these documents that were at Mar a Lago that are now not there anymore.They allegedly included U.S nuclear secrets and vulnerabilities.Take a listen to former US.Attorney General Bill Barr.I was shocked by the degree of sensitivity of these documents and how many there were.Frankly, he had no right to maintain them and retain them, and he kept them, in a way, at Mar a Lago that anyone who really cares about national security, their stomach would churn at it.You care about national security.When you saw the insecure way those documents were stored at Mar a Lago.Did it make your stomach churn?Well, it's certainly of grave concern.So the chair and ranking of both the House Intel and Senate Intel have seen some of the documents, both from the Biden cachet and the Trump documents itself.And I can tell you that from having looked at both of those documents, I have grave concern about both of those type of documents being out in an unsecured place.Both of them included details of national security issues that should not have been outside of a controlled environment.I take your point.The White House does say that President Biden's team contacted International Archives the very same day they found these documents.

The White House does say that President Biden's team contacted International Archives the very same day they found these documents.That's obviously not what Trump did.He stonewalled for 14 months and allegedly hid documents from his lawyers in order to obstruct the efforts to return those documents even after receiving a federal subpoena.Take a listen to Bill Barr again describing the process.They talked to him for almost a year to try to get those documents, and he jerked them around.They finally went to a subpoena.And what did he do?According to the government, he lied and obstructed that subpoena.So they acted in a very patient way.And what they were met with was, according to the government and the indictment, very egregious obstruction.A lot of legal experts look at the indictment.They say, if Donald Trump had just turned over the documents, we wouldn't be here.He wouldn't have been charged with anything.Right.Well, I have a great deal of respect for Bill Barr, but I have to correct something that he said.My committee actually brought in the archivists, and we had them testify as to what was occurring with the issue of the Trump documents.We've released the transcript, and actually, the Archives was unaware that they had classified documents.The first cache of documents that were delivered to the Archives was the first time that they became aware that there were classified documents involved.They were pursuing just presidential records.And then within four months of Trump giving surrendering to them, classified documents.When they opened the boxes and were surprised that he even had classified documents.Within four months, Marlargo was raided.So it wasn't this entire time, but it certainly was an unacceptable time.But it is, in the view of the government, obstruction.Here's your colleague, Republican Congressman Don Bacon, who's an Air Force veteran who knows from national security documents.This is his description of how tough it is for Republicans to defend Trump and whether they should be at all.We're missing the obvious.We have somebody that has hundreds and hundreds of top secrets in his house showing it to unclear people and then he lied about it.I'm not in the mood for mode for defending that and I don't think my colleagues should either.It does look, if you look at the indictment and the charges are there, unless there's something, some defense we have not yet heard, it does look like President Trump broke the law.Well, and again, this is a legal process that is going to have to go forward.What my committee is doing on a bipartisan basis is looking at how did this occur, what laws need to be changed?Well, we heard from the archivists that every administration since Reagan has delivered to them documents that included classified and unclassified documents mixed.

Joining me now is New Hampshire Republican Governor Chris Sununu, who declined a 2024 presidential run.Nice to see you here in Washington.You just heard that you've heard lots of other Republicans since the news of the Hunter Biden plea deal broke yesterday, talking about the two tiered system and so on and so forth.But my question for you is, since your whole strategy now when it comes to 2024, is to make sure that Donald Trump is not the Republican nominee, isn't that messaging playing right into his hands?

Well, on that note, I know one of your big arguments, as I said, is that you don't believe Donald Trump, if he's the nominee, can win in November, in large part because he can't necessarily reach independence.I just want to show you and our viewers part of the new CNN poll from from yesterday.27% of Republicans think Trump should end his campaign.In light of his indictment, that number is 62%.When it comes to independence, the voters that he's done, you need you can't win.Look, the trouble that former President Trump has in November is no one's on the fence about him, right?Either he's such a known political commodity, either you'd vote for him or you wouldn't.There's very few actual undecided.So when 62% of independents say, not only are we not going to vote for you, but you need to get out now, that's a done deal for folks.And that's exactly what happened in 2022.It's exactly what happened in 2020.I don't think he's going to lose because I just think he might lose in November.He's a proven loser with a proven losing message, with proven losing candidates.Why, as Republicans, are we going to do this a third time or fourth time and think it's going to turn out better this time?It's going to be the same story when we have other really great candidates out there.Let's give them a shot.Let's get them on the debate stage galvanize about behind one of them.And I think if it's a one on one Trump versus one other candidate, he loses.Okay, so I want to ask you about that as well, because I want to put back up the general poll number from yesterday with the sort of top line from all of the candidates who are in the race.

Now to breaking news CNN poll numbers.A post federal indictment snapshot of the Republican race shows Donald Trump still leads, but that he has a big vulnerability, several of them actually, among Americans, even those in his own party.I want to get straight to CNN political director David Challion at the Magic wall.David, walk us through these fascinating new numbers.Yeah, Dana, we are seeing a bit of softening in Donald Trump's support among Republican and Republican leaning independents in this 2024 nomination race, even though he is still clearly the big frontrunner for the nomination.Take a look at that horse race, if you will.Right now you see that Donald Trump's at 47% support among Republican and Republican Leaners DeSantis at 26%.Everyone else single digits.But note, here the change.So, back in May, Donald Trump was at 53% Support.He's down six points.That's one note of caution.How about favorability about Donald Trump?Take a look here.Now.He's down at 67% favorable among Republicans and Republican leaders.That's ten points below the 77% he was at just in May.And those that say they will never consider Donald Trump for the Republican Party nomination are on the rise.You see now it's at 23% of Republicans, and Republican leaders won't even consider as an option.That was down at 16% in May.So those are all warning signs in the primary context for Donald Trump.Still, clearly a 21 point lead is a place you'd rather be than not.In terms of the general electorate and the overall broader American audience, there's big, broad sense of approval of the federal indictment.61% of Americans overall in this poll approve of the federal indictment.In the Documents case, you see overwhelmingly among Democrats, 67% of Independents approve of the indictment, about a quarter of Republicans.Now, Americans do broadly see politics playing a role in this.71% say so in this federal indictment.Even a slim majority of Democrats say politics is playing a role at this.Clearly, Independents and Republicans believe that as well.A majority of Americans, Dana, 59%, nearly six in ten say Donald Trump should end his campaign now, due to these federal charges.In the Documents case, 90% of Democrats, 62% of Independents think he should end the campaign.Now, only a quarter of Republicans.That all gets at the question inside the Republican Party whether or not Donald Trump is their best foot forward to beat Joe Biden in November of 2024.And what you see here is a split decision among Republicans.51% of Republican and Republican leaders say their chances are best for victory, with Donald Trump at the top of the ticket.49% say their chances would be better with someone else.Dana, fascinating numbers.David, I know you're going to come over to the table, and while you do, I just want to put back up on the screen.There's a lot of numbers there, and I think it would be good for our viewers and for all of us to kind of keep digesting.Let's just go to the first one, the horse race.There you go.You do see 47% is a big percentage of support, particularly when you have all of those other contenders in the race.But you do see slippage there for Donald Trump.He definitely still has a grip on the party.But now I think about how DeSantis in particular has really tried in this campaign to differentiate between Trumpism, between the values or the policies of the previous administration, saying that he supports those, even galvanizing off those, but then differentiating that between the actual former president saying, I can actually do Trumpism better than Trump in a way.

But now I think about how DeSantis in particular has really tried in this campaign to differentiate between Trumpism, between the values or the policies of the previous administration, saying that he supports those, even galvanizing off those, but then differentiating that between the actual former president saying, I can actually do Trumpism better than Trump in a way.And you wonder, when you look at these numbers, if they provide a glimpse that that narrative and that focus that he's had is starting to soften support among Trump supporters, who may say, look, yes, we did support the policies of the previous administration, and we support how Trump galvanized us.But now we have various multiple options of people that can do that.It's no longer solely Trump as an option for pushing forward that narrative, those culture wars, those policies that galvanized us in the first place.And as you discussed this leanne, I want to bring back one of the other numbers that David talked about, which is his overall favorability rating.And this is just with Republican or Republican leaning voters ten points down, ten points, 77 to 67, and his unfavorable the other side of that coin up to 27%.This actually goes against conventional wisdom, talking to a lot of Republicans immediately after this indictment, when they said that this indictment was going to help Donald Trump in the short term.

CNN's Elena Train joins us now live in Washington.Elena, pretty striking comments.What do you make of them?Well, they are very striking, Rahel.These are some of the starkest comments that we've heard, not just from these former Trump administration officials, but Republicans in general, regarding the federal charges that the former president is facing.And both Mark Esper, his former defense secretary, and his former Attorney General Bill Barr are saying that if he is convicted in this case and the charges against him are proven to be true, that Donald Trump should not be president again.And I think what Mark Espert said is really a dire warning if Donald Trump is reelected for a second term and is back in the White House.He said that what Donald Trump did was irresponsible and it put the lives of service members at risk.And as you said Rahel, we also have heard some very strong criticism from former Attorney General Bill Barr.He's repeatedly gone on the airwaves to talk about these charges and the serious of them.And he said that the charges are damning and that Donald Trump is not a victim in this.Let's listen to what he told CBS News yesterday.Would he put the country at risk if he was in the White House?Again, he will always put his own interests and gratifying his own ego ahead of everything else, including the country's interests.There's no question about it.This is a perfect example of that.He's like you know, he's like a nine year old, defiant nine year old kid who's always pushing the glass toward the edge of the table, defying his parents to stop him from doing it.It's a means of self assertion and exerting his dominance over other people.And he's a very petty individual who will always put his interests ahead of the countries, his personal gratification of his ego now.Rahel I think it's important to note that Bill Barr and Mark Esper were not just former Trump administration officials.They were cabinet level secretaries and attorney general.And I think that they also had access to some of the most highly sensitive materials that Donald Trump had when in office.And both of them had said that the documents that were in his possession were very classified and should have been in the hands of the national archivist, should have not been taken back with him to Marilaga.Rahel things getting very personal.Fascinating here.AG barr.Call him petty.Elena, has Donald Trump's team reacted or responded to any of this?

Elena, has Donald Trump's team reacted or responded to any of this?Well, obviously, Donald Trump's team is arguing something very different.I was in Benminster when he returned from his arraignment in Miami last Tuesday and spoke to a crowd of supporters at his golf club in New Jersey, and he said that he believed donald Trump said that he believed he was entitled to taking these documents with him and that others were not prosecuted for doing the same thing.Of course, prosecutors in this case are arguing that the materials in his possession were some of the most classified documents and that his unwillingness to turn them over amounts to obstruction.But I think what's really striking about this is Republicans in Congress, as well as some of Donald Trump's 2024 presidential rivals, are kind of leaning into what Donald Trump is saying and the excuses he's making for having these materials, whereas Mark Esper and Bill Barr are not.And I think that's why it's very interesting to hear where they differ on this from rest of the Republican Party.Rahel Elena Tree, life force in Washington.Elena thank you.

Joining me now is MSNBC legal analyst Andrew Weisman, former FBI General Counsel and former senior member of the Mueller probe.Always great to see you, Andrew.I want to read to you from the discovery court filing, which is this is the thing that's got folks intrigued.The government will disclose any payments, promises of immunity, leniency, preferential treatment or other indictment inducements made to prospective government witnesses within the scope of Giglio versus the United States or Napway versus Illinois.Can you explain what that means in regular people terms?Well, I'll try.I am a lawyer and a law professor, so I'll give it my best shot.So under the Constitution, the government has to disclose evidence about its witnesses that could impeach them.So, for instance, let's just take Michael Cohen.If Michael Cohen is called as a witness in the Manhattan District Attorney's case, he's not going to be called in the Mara Lago case, but in the Manhattan District Attorney's case.The Constitution requires that the government turn over to the defense all of his prior bad acts, everything that could be used to impeach him, most notably the fact that he has admitted that he committed perjury for Donald Trump, but nevertheless, he committed perjury.So what that letter is saying is we are going to turn over everything that could be used to undermine the credibility of our witnesses.And that's part of what due process requires of the government and every defendant, whether it's Donald Trump or somebody who's much less notable without those resources, is entitled to get from the government.Let's just say Donald Trump, because he does have a pretend Twitter and he does use it quite extensively, were to what does he call it, truth out, something that he learns in this discovery phase.What would be the penalty?Because he has been told he's not supposed to do it.What if he did it anyway?Yeah, that's a great question.So one of the things that the government has done, which I think is totally right, is they have turned over this discovery really early.I mean, this is exactly what you want our government to be doing, but it also allows them to say to the judge they want a quick trial because they've turned over the discovery so early to the defense.But that does mean that Donald Trump has a greater opportunity to try and tamper with witnesses, which is what your question goes to.Now, both in the Manhattan DA's case and in this case, the judges have issued orders saying what he can and cannot do with that evidence.But an order is a piece of paper and the defendant here, defendant Trump, is already being accused of violating various laws, including a grand jury subpoena.So that order remains to be seen.Whether it is going to work.Having said that, if he now tries to tamper with witnesses, that is such a serious offense.If you might remember, Paul Manafort, who I prosecuted in connection with the Mueller investigation, did just that.He tampered with two witnesses while out on bail.And you know what happened?He went to jail.That was somebody who was out on bail.And if you tamper with witnesses, if you commit that serious a crime while you're out on bail, that's an obvious consequence.So Donald Trump would obviously have to be caught doing this, but it can happen.And then the consequence is he'll be running for the Republican nomination from inside of a jail cell thing, of tampering with witnesses.He has a co defendant, Walt He Nada, who's also facing very serious counseling, lying to the FBI.Let's just say he learned in the discovery what Walt Nada has said in the course of the investigation, and then it'd be hard to prevent him from tampering with him.Right.He practically lives at Mar a Lago.Is there a way that he could be sanctioned for that?And then part two of my question is, do you think that Jack Smith is still trying to work Walt Nada to get him to flip at this stage?So I think Walt Nada would be the hardest person to be able to detect whether there is sort of continuing tampering with him.The judge did say that they can only speak about things unrelated to the case, but, I mean, good luck monitoring that.So that's a tough one.But I do think at this point, whatever collusion favorite word of Donald Trump there is between Donald Trump and Nada has happened.In other words, whatever cooked up story, they have that's sort of baked in.And that is presumably why Walt Nada is now being charged for making false statements and obstructing.So I do think it'd be hard to catch that.Of course, the issue of Walt Nada flipping.Obviously the government tried to have that and tried to do that.Walt Nada, as is his right, decided not to.And to face the music, that's also his constitutional right.At this point, it's really clear that the government doesn't need him.So his window of opportunity to come in may be over, maybe close.Exactly.And at this point, he decided, as we used to say, which side of the V he wants to be on in the United States versus the defendant.He was given an opportunity to be on the United States side.He has decided, as is his right, to be on the other side.You never know if it's ultimately too late.But I can assure you, knowing Jack Smith, that if he comes in, he's going to have to plead guilty to what dead.
